Who Is Eligible for Sex Offender Registry Removal?

Under Iowa law, you can apply for sex offender registry modification to get your name removed from the registry if you are on parole, probation, special sentence, work release, or any other type of conditional release, AND have satisfied the prerequisites of the modification provision and are no longer subject to correctional supervision.

The following things need to be true in order to approve the modification of your sex offender registry in Iowa:

  • You are not incarcerated.

  • You have been required to register as a tier 1 offender for at least two years or as a tier 2 or tier 3 offender for at least five years.

  • You have completed the sex offender treatment programs.

  • The risk assessment classified you as low risk to re-offend.

  • If you are under supervision, you have the judicial district stipulation.

  • You file in the county of a principal residence.

  • You have provided notice of the application to the county of conviction.

  • You have provided notice of the application to the sex offender registry.

  • Final orders are forwarded to the victim’s known address.

The 4-Step Process to Get Off the Sex Offender Registry

The process of getting your name off the sex offender registry consists of four steps:

  • Contacting an attorney. If you want to remove your name from the sex offender registry, you might need legal help from an experienced attorney who will analyze your circumstances and assist you through the process.

  • Reviewing your eligibility. Your attorney will help you determine if you are eligible to get your name off the sex offender registry.

  • Filing a petition. Once your attorney has determined that you are eligible for removal, your next step will be to file a petition with the help of your attorney.

  • Wait for a response. Finally, once you file the petition, you will need to wait for the court to review it. Wait for the response to know whether or not your petition for removal has been approved.

At my firm, I am a professional sex offender registry removal attorney in Council Bluffs, Iowa. I can assist you through the above-mentioned steps, with the goal to get your name off the sex offender registry.

Requesting a Sex Offender Risk Assessment When Filing an Application

Risk assessment is one of the most critical yet misunderstood aspects of getting your name off the sex offender registry. When filing an application to request a sex offender risk assessment, you will be required to pay a $50 fee. If you do not pay the fee, your application will not be processed.

If your application is granted, a date for the risk assessment will be scheduled. The assessment fee is $550. If the evaluator or designee is ordered to testify in court during the modification process, an additional $600 fee will be added.

Filing an application to request risk assessment does not guarantee that an assessment will be granted. In addition, if your risk assessment is granted and completed, it does not guarantee that you will be able to get your name off the sex offender registry.

Get assistance from a skilled attorney as early as possible. Your attorney will help you prepare for the sex offender risk assessment and guide you through all steps of the process.
